Legal Question in Criminal Law in Alabama
Criminal Matter
Entered business deal with builder to build cabinets. He made deposit up front. Then fired me from job. The money had been used for materials. I offered to pay money back in installments but a year later the person had me arrested for theft in the first degree. Would this be a criminal or civil case?

It sounds like it should only be a civil case, but since you have been arrested it has become a criminal case. You need to get a criminal defense attorney involved in this matter right away to start building your defense to this allegation.
If it was a deposit on the work and you spent the deposit on materials used on the job with this customer, and you can document that fact, then it seems that you would have a very good defense to this charge. Also, theft requires an intent to deprive the owner of property, and it sounds like this is just a dispute over how much money you owe him out of his deposit. However, we would have to discuss the facts in more depth because the details in a situation like this can be very important. I would also want to see your contract, if you had one, to get a better idea of the agreement you had with the builder.
