Criminal Trespassing
Does a charge of Criminal Trespassing have to prove criminal intent to be found guilty?

intent is not an element of any of the three degrees of trespass in alabama, however, "knowingly" is an element of all three degrees of trespass. "knowingly" means that the defendant did not trespass accidentally or with the belief that he had the right to be where he was. please call me if i can be of further assistance at 205-879-9595
