what defines shoplifting, do you have to leave premisses?

In the state of Alabama as a juvenile, can you be charged with shoplifting while still in the store or do you have to leave the building before you can be charged? The juvenile has never comitted a crime and admitts he might have chickened out and put the item back. He was detained right after putting the item in his pocket. Do they have a case?

theft 3rd is a misdemeanor in alabama. shoplifting is usually catagorized as theft 3d as long as the value of the item is less than $250 and there are no priors. theft 3rd occurs when the item is taken from where it is stored or displayed and concealed with the intent to steal the item. the crime can be accomplished before leaving the store, but it always depends on the particular facts in each case. call me for more information 205-879-9595
