Legal Question in Criminal Law in Alabama
dpmestic violence & paraphernalia
my husband and i got in an argument about the location of an illegal prescription that belonged to me.he moved them and i became angry. the fight turned in to a shoving match and in the process i scratched his cheek. he called the cops. the cops siad i would be arrested for d. v.as i had no visible injuries.one of the officers asked for my i.d. and i said it was in my bedroom.he wanted to follow me for his safety.the position of the i.d. in the room was such that all he had to do was stand at the door and watch me.however he walked in the room and looked around and saw a empty maurijauna pipe. he asked whose it was, and i told him it belonged to my husband.he then started asking me about the fight.i told him the gist, but not the details.he asked what, but i wouldn't say.he said why, is it illegal or embarrassing?i answered embarrising obviously.that ticked him off i guess because he charged me with possesion of parphenalia as well as my husband, even though my husband told the officer it was his. is there anything i can do to have this charge dropped? also can my husband drop the domestic charge. i live in baldwin county alabama.

Re: dpmestic violence & paraphernalia
you need to call a lawyer. dropping charges is up to the prosecutor and the court. it is not necessarily up to your husband although his wishes may be considered by both the court and the prosecutor. you need to call an attorney asap
