Alabama does not currently have a law permitting expungement of a criminal record unless there is a mistake in the record. Earlier this year there was an attempt to get the Alabama legislature to pass an expungement statute, but the bill did not make it all the way through the process. The bill is going to be resubmitted in the next legislative session, so it is our hope that a procedure will be created next year.
There is a procedure for reinstating certain rights that are lost from a felony conviction, and there is also a way to apply for a pardon for a past felony. However, expungement is not going to be an option, at least until next year.
