Legal Question in Criminal Law in Alabama
Forged urinalysis
My son was in an accident that resulted in the death of an 11 yr. old child. He has not denied responsibility, but we feel that a life sentence was out of the ordinary. He had been drinking, but both the BAC and the breath test showed .08. When we received ''discovery' it included the results of a urine test. He swears that he never gave a urine sample, According to the timeline, the urine sample was actually given right there at the scene, and upon closer examination, we realized that his signature had been forged on a consent form. We retained a reputable ''questionable document examiner'' who confirmed our belief that his signature was indeed forged on the cosent form. The ''urine'' had a much higher alcohol content than the breath or blood tests showed, as well as other chemicals. The DA based much of her argument on the urine test results. Our lawyer said our findings were unimportant. What should we have done/do?
