Legal Question in Criminal Law in Alabama

illegal search and seizure

I was traveing as a passenger in a friend's car, we were pulled over for darkly tinted windows. Neither I nor the driver was under the influence or rude or uncooperative in any way. My ID was ran and OK'ed. We were in the parking lot of a reputable chain motel, at which I had rented a room, and showed the officers my receipt and room key. I needed to urinate, and was told to ''get out and go on up to the room.'' Instead I was unwillingly searched for 'weapons', and having on a very short revealing dress, can the 2gram vial of methamphetamine they found IN MY UNDERWEAR be admissable evidence.

Re: illegal search and seizure

your facts are not totally clear, but, an officer can make the driver and passenger exit the vehicle during a vehicle stop and under certain circumstances can search the occupants for weapons for the police officers safety. i would need more facts in order to completely answer your question as it involves search an seizure issues that are generally very complicated. you of course need to consult an attorney asap.
