Legal Question in Criminal Law in Alabama
First offense marijuana possesion
I was recently at a party that got busted by the cops and I was caught with a small bag of marijuana(less than a 1/4ounce). I have no record, have never even had a speeding ticket, am on an academic scholarship, and break no other laws. I use marijuana for medicinal reasons(which I know is irrelevant in Alabama). My question is when should the cops have read me my rights? I volunteered my marijuana when they said they were going to search everyone and they immediatly handcuffed me but did not read me my rights until three hours later at the jail.

Re: First offense marijuana possesion
your marinda rights should be read to you when you are in custody and before you are interrogated by the police. you need to see an attorney regarding this case on the issue of how the police came to know you had marijuana on your person and also regarding any alternate type of punishment available to you. 205-879-9595
