Legal Question in Criminal Law in Alabama

Should he plea?

My brother (20) was doing doughnuts in a parking lot w/friend. The police came; he fled. Police pursued, bumping his car. This bump caused the car to go into the ditch and friend was subsequently killed. Police delayed in calling in accident. (I believe a neighbor called it in actually) My brother is now charged with murder. The car was destroyed before he received a lawyer, so no evidence of bump is available. He was assigned a reluctant legal aid lawyer who now wants him to plea down for manslaughter. What are his options? This is his first felony (he did have a small spat once, but no charges were filed). There is no evidence of alcohol. The police also have a civil suit being brought against them for 3 other teens' deaths in similar cases. Should he take the plea?

Re: Should he plea?

Hi,i'm in the office therefore i cant study for your case very hard.but at first instance when i read it.if u didn't have the proof to prove that ur innocent same also the prosecution doesn't have the proofs & the burden to prove that you are guilty is on the prosecution.so u just have to reject or deny whatever they charged you.also you can get THE BENEFIT OF DOUBT also,so just don't worry & consult a good lawyer, you need to go in for pains but you will win the case on its merits.also your brother have no reason to kill him.i.e.(men's rea)in legal language.what the post mortem report says?you have not mentioned it in the mail.so just check the deceased person's(P.M.)report.wil see you with some good news from your side.o.k.bye & take care......vedant v.vyas

Re: Should he plea?

Hmm, that's a tough one. What county is this?

Would he serve any time based on the DA's offer?

Can he afford to hire his own attorney?

Please give me some more details.
