Legal Question in Criminal Law in Alabama

Rape/Sexual Misconduct

Apr. 7, 2008, I was raped. An incident report was taken by local law enforcement, but the incident was never investigated. The DA's office, Circuit judge was notified, with no response. The AG's office, Crime victim's unit were notified. ABI did an investigation. I was told to get a warrant for the offender for sexual misconduct because my clothing were too contaminated to extract DNA. The offender admitted sexually assaulting me. Why won't Talladega County do anything about it? Why won't they let me sign a warrant? Why weren't my clothing sent to forensics? Why did Tall. Co. say the invest. was unfounded when ABI said differently? Why did the DA tell me to file a motion to talk to him? The CC judge never responded to a 5 pg. letter that I wrote begging for help. I spent day in a Psychiatric ward after this horrific incident. Doesn't anyone care? There is someone out there who can help me. I have info that the AG's office sent me after they completed an investigation. HELP!!!

Re: Rape/Sexual Misconduct

The circuit judge has nothing to do with whether charges are filed or not. You need to go to the law enforcement agency, whether it be the city or county, whoever the jurisdiction is where the incident occurred, and sign a warrant for the arrest. There you provide an affidavit which gives grounds for an arrest. If you continue to not get results, please feel free to contact me, preferably in the evening, and I will discuss it further with you. My office number will ring in my home afterhours and you can get it from my website.
