Legal Question in Criminal Law in Alabama
Reckless Endagerment
I was arrested last night for Reckless Endangerment for shining a laser pointer out the window of my car at signs and trees around the road. Somebody in front of me called the police and said that my laser hit their mirror one time and they couldn't see, which was untrue. The police confiscated my laser, which was about 300$ brand new.
I read that according to Alabama State Law, reckless endangerment is a Class A misdemeanor. I am 18, attending the University of Alabama and getting ready to go to law school and have never been in trouble for anything other than a speeding ticket. I am asking for some legal advice on what my options could be, such as pleading youthful offender, or..?

Re: Reckless Endagerment
You are right, reckless endangerment is a Class A misdemeanor, and you do not want it on your record if you can avoid it. At 18 with no prior record, you should be eligible for youthful offender status. You may also be eligible for a withheld adjudication or pretrial diversion. However, I would recommend that you hire an attorney to represent you to make sure that youthful offender status and/or a withheld adjudication is granted, especially since you are planning to go to law school. Also, if you are planning to fight the charge, you are going to need an attorney to handle the trial for you. I would strongly encourage you to retain an attorney before you go to court so that you can make sure that, whether you plead the case or take it to trial, you get the best result possible. If you cannot afford an attorney, you can file an Application of Substantial Hardship to request a court appointed attorney.
Whether you retain an attorney or get one appointed by the court, make sure you have an attorney when you go into the courtroom. If my office is able to assist you, please give me a call.
