Legal Question in Criminal Law in Alabama

Statuatory Rape

What is the law for legal consent in the state of Alabama? From what I've heard, any male over the age of 18 that engages in sexual intercourse with a female more than 2 years younger than the male is illegal. Is that correct?

Re: Statuatory Rape

In Alabama, a person commits first degree rape if he, being 16 years or older, engages in sexual intercourse with a female who is less than 12 years old.

Second degree rape is where the person, being 16 years old or older, engages in sexual intercourse with a female less than 16 and more than 12 years old, provided the person is at least two years older than the female.

Additionally, in Alabama a person is considered incapable of giving consent if they are less than 16 years old.

I hope this helps. If you have any further questions, you can give me a call at (334) 361-3535.
