Can you trespass in a cemetary
My son and friends were arrested for ''criminal trespass in the 3rd degree. It was dusk. There were no signs of no trespassing and no signs of times of open and closed. The only sign was the name of the cemetary. There were no gates and they had never been there before or been given notice. He pled not guiltly. He doesn't have lawyer. How much trouble is he in? All they were doing was talking in a graveyard.

trespass 2nd degree is a misdemeanor in alabama punishable by up to 6 months in jail and/or $500.00 in fines plus court costs. if there has been an arrest you need to contact an attorney asap to make sure you do not plead guilty to something that you did not do. trespass in the third degree is a violation that allows for lesser penalties. your son is in trouble, the degree depends on the degree of the offense and the prosecutor. please call me if i can be of further assistance. 205-879-9595
