Legal Question in Criminal Law in Alabama
Wrongful termination/prosecution
My (ex)employer approached me and told me I was being fired for theft. He then had a portion of paperwork investigated and the amount is half his original $ amount. I have been charged with first degree theft and waiting for trial date. Had the rest of the paperwork been included, there would be no charges. I expect to be found innocent, as i have a good atty handling this. Now this person is filing a civil suit! This person has vowed to destroy my life (to me by phone). This person is not ''rich'' by any means. There is more to this, but I feel it can not be posted publicly. I am a single parent with limited resources. I held the same position with another company for a much longer term of employ,(in the same place of business) with no incidents.
1.) Can this civil suit be postponed until the criminal case is over?
2.) What kind of ''proof'' is needed for him to file a civil suit?
3.) Will I need a seperate attorney?
4.) Should I file a countersuit now or wait? (most important question)

Well, you have several good questions there. A lot depends on how the criminal case comes out.
You don't necessarily have to wait to file a countersuit against him.
