Legal Question in Education Law in Alabama

School Records

Can a person be allowed a discovery period BEFORE he files a complaint in the District Court in Birmingham, Alabama? I need to know exactly what is contained in my school records, but the school (University. of Alabama at Birmingham) has repeatedly refused to release them to me against it own guidelines clearly set forth in the school catalog.

Re: School Records

The answer is possibly, unfortunately you have not given me enough information in order to answer

this question. If we are talking about an action in Federal District Court, do not even think about

filing a complaint by yourself. Many attorney's avoid Federal Court as it can be, shall we say an

interesting place with many precise rules, etc...?

Further, depending on what the problem is, you may be better off in State Court, then if the

University wishes, they can file for removal if there is a genuine Federal question, and you can avoid a lot of the initial complications.

If we can be of assistance, please feel free to contact us at Forrester & Associates 256-435-1007.
