Law Suit filed by Power of Attorney for Elderly
My MIL who has power of attorney fo her elderly father (94 years old) has filed a suit against a family member on his behalf. She has requested a jury trial.
Will he have to appear and court?
If he dies before this goes to trial will the case be dismissed or can she still pursue this ?

Re: Law Suit filed by Power of Attorney for Elderly
It all depends on the nature of the suit, his ability to testify, whether he will even be required to testify and what other alternatives might be available. If he dies during the trial, his executor would take over the case from the POA.
