is it legal for a doctor's assistant to treat patient and take money from patint while dying

Please define "taking money". If the assistant is working under a doctor (provider) and is being paid for services by the patient (billed by the provider) AND the patient is not incompetent and understands why he is giving money it is fine. If the patient is giving money to the assistant and does not understand why, is being coerced to give money or not for billable medical services it is probably not OK. You need to seek the advice of an attorney in your area.
