16 year old wants to live with non-custdial father

My 16 year old wants to live with his father and i. His mother has full custody of both their boys. Her and her husband are abusive to the 16 year old but not the 15 year old. They have stated if he moves in with us he cannot bring anything of his except what he is wearing. How can we protect him from them when we file for custody and can we file our selves or do we have to have an attorney?

you really need an attorney to try and modify the divorce decree regarding custody. you may be able to obtain a temporary restraining order upon filing the petition to modify if you have very strong evidence of abuse of the 16 year old.
