Legal Question in Family Law in Alabama

Adoption

My common law husband has been taking care of my daughter since she was born and he is not her biological father. Her father does not have anything to do with her. I was wondering how do get parental rights signed over to my husband.

Re: Adoption

In Alabama there are several questions that have to be answered before your question can be answered. Were you married to the biological father? If so, are you divorced? If you were not married, then the biological father is not the "legal" father, even though he may have signed the birth certificate. Then the next step would be, the common law husband would need to become your legal husband. Then he could adopt the child and parental rights may be terminated of the biological father based on abandonment and failure to register with the putative father's registry. Please call me if I may be of assistance.
