Legal Question in Family Law in Alabama

Adoptive parents helping Birthmom.

How far, financially, can an adoptive parent help a Birthmom while pregnant? If the adoptive parent helps out financially while birthmom is pregnant, can she be breaking the law and would it be considered buying a baby? This would be a private adoption, no agency involved.

Re: Adoptive parents helping Birthmom.

In Alabama, it is not unlawful to pay the maternity-connected medical or hospital and necessary living expenses of the mother preceding and during pregnancy-related incapacity as an act of charity, as long as the payment is not contingent upon placement of the minor for adoption, consent to the adoption, or cooperation in the completion of the adoption.

I hope this helps. Please feel free to call me at (334) 361-3535 if you have any further questions.

Re: Adoptive parents helping Birthmom.

under ala law it is a class c felony for any person to pay money or anything of value to a parent for placement of a childfor adoption, for the consent to an adoption, or for cooperation in the completion of an adoption of his or her minor. however payment can be made for maternity-connected medical or hospital and necessary living expenses of the mother during pregnancy-related incapacity as an act of charity, as long as the payment is not contingent upon placement of the minor for adoption, consent to the adoption, or cooperation in the completion of the adoption. this answer is from the ala code concerning adoption and payment of expenses to the birth mom. call me if i can be of further assistance.
