Legal Question in Family Law in Alabama
affidavit of paternity
I wanted to know if a man signed an affidavit of paternity when he and the mother both knew that he was not the father, can this affidavit be abolished with the agreement of both man and woman. Also the biolgical father is willing to sign the affidavit of paternity and or adopt which ever he has to do. Or do we have to go to court and have a termination of parental rights and go through an adoption process. When the real father wants to sign the paternity forms?

affidavit of paternity
This is a question that is going to have to be answered by a practioner in your state, and one you will sit down with and who will ask you questions about details and who will probably want to see the Affidavit.Generally speaking, at least here in Tennessee where I practice, your Affidavit doesn't need to be "abolished" or anything else -- it is not a court order. All you would need to do with your affidavit is nothing.... and nothing will happen with it.
