Legal Question in Family Law in Alabama

Age of terminating child support or mancipation

I devorced on july of 1990. I have 2 children for which I pay child support. My oldest will be 20 this Dec. and my youngest will be 18 this weekend and will be graduating this May. In my divorce decree all it stipulates is that I pay according to rule 32, and nothing about an age limit. I called the clerks office asking if I can terminate child support when my 18 year old graduates and they said it depends on what my devorce decree says. I told her it didn;t stipulate any age. She said I would have to contact my attorney that did the divorce and see if the age was 18 or 19 back in July of 1990 as to weather I can terminate my child support. I am still paying the same ammount for the 1 as I was paying for the both of my children. My old attorney no longer excist. Can you tell me weather I can terminate when she graduates or do I have to pay untill she is 19.

Re: Age of terminating child support or mancipation

You would need to file a motion to terminate when the child reached 19. If he is self supporting, you could file sooner. You need to consult an attorney in your area.
