Legal Question in Family Law in Alabama

Boy - age 12 wants to live with one parent only

My stepson wants to live with his father and I. He hates living with his mother. In Alabama, can we go to court and let the child decide who he wants to live with? He also has a 9 yr old sister. Will there be any chance that she could live with us also if she wants to? Will they split the 2 children up?

Their mother is not very supportive and does not work.

a child does not have the final say in alabama as to who will be its custodial parent. a judge may consider his wishes or ignore them altogether. if the child is of mature age and character it may make a difference, however the judge is bound to take the action he does based on his belief in what is best for the child, not necessarily what the child wants. a judge may also split up the siblings of a marriage if he deems it in the best interest of the children. it all turns on what the judge believes is in the best interest of the children and he can consider all legal evidence he chooses. call me if i can be of further assistance 205-879-9595
