Common law marriage does exist in Alabama, but it requires more than simply living together. In addition to cohabitation, the parties must have the legal capacity to marry, they must have consummated the relationship, they must have intended for their relationship to constitute a common law marriage, and they must have held themselves out to the public as a married couple.
