Legal Question in Family Law in Alabama

How to get my child back

My husband and I have been having problems for a long time. We have one child together, and he has taken him from me. I haven't seen my son in 3 days. My husband has no lisence, and he has a background. I want my son back! What can I do? The police said he has the same right as I do to have my son. He is not involved in my son's life. He never has anything to do with our son. He does not take care of him, I take care of him. He has only taken him away to hurt me! How can I grt my son back fast? I cannot wait to go to court.

If the safety of your son is an issue, the first thing you need to do is to go to the juvenile or family court and file a dependency alleging safety is an issue. You will probably need the assistance of a lawyer as in most cases there will be a reluctance to get involved. But if there is alcohol, drugs and other concerns, then it is valid and you can get a pick up order to be issued perhaps by DHR once they investigate. You need to have your witnesses with you that can back up your assertions on the allegations. If in this area, please feel free to call upon me.
