Should I file for Full Custody? Should I change my child's last name?
Here is what happened: Had a child out of wedlock, thought we would get married, found out who is really was, let him down easy, he begins leaving frightening messages on my voicemail, got where I made sure that someone was with me at all times that he was around me and my son, he is not around much, only comes around during holidays when his family is around asking him questions about his son in which he cannot answer. When he is around he demands to see his son, I give in, we schedule appointments, he sticks to the appointments for a few weeks (mainly while his family is around)then after the holidays are over and everything has settle down he is gong for 2-3 weeks to 3-6 months. We have not heard from him for 4 months and one week. Of course due to Father's Day around the corner he calls and leaves a message on my voicemail yesterday. This ends here! No more popping up after several months. I should have done this a long time ago. i want full custody. He hasn't paid child support in over a year and you know what I am not interested in child support. I want all his rights taken away and given fully to me. Is this possible and if so, can I change his name?

It is frustrating when the non-custodial parent does not exercise their visitation. The hurt and pain that the child suffers compounds the problem for the custodial parent. However, from the facts you present it appears to me that you already have full custody. I understand that there is a child support order, but did the judge specifically address the issue of custody/visitation?

You can not file for full custody as you more than likely already have custody and he just has visitation. There are questions which need to be answered: Do you have a court order for child support?
