Legal Question in Family Law in Alabama
Child custody
I got full custody of my girl about two years ago from her mother, and since then the mother has been married. She gave me custody without going to court because she was scared the state would take her other two if I would prove her unfit, and I had a very good chance and she knew it.I think she got married so she could have a better chance of getting my girl back because she is no better now than she was then.I have a good study job and a stable place to live unlike her,and my child is well taken care of.Does she have to prove me unfit or can she just get custody without any good reason?

Re: Child custody
your x wife must file a petition to modify the terms of your divorce and prove a change of circumstances in order to attempt to change the custodial parent. she cannot get a custody change without any good reason. there has to be a change in circumstances and the judge will be concerned with the welfare of the child.
