Legal Question in Family Law in Alabama
child support use
Hi. My ex-husband and I have one daughter, age 11. I recently had to garnish his wages for child support, as he failed to pay the way we originally agreed. My question is, he believes the money should be spent solely on things like clothes, toys, movies, etc. Could you please tell me what child support is supposed to be for? Is it just supposed to be for things he says, because I have used to help with electric biils, groceries, etc. Thank you for your time.

Re: child support use
You as the custodial parent have the discretion to use the money however you see fit, for the benefit of the child. This could include food, insurance, utilities, rent/mortgage, car payments, tap dancing lessons, clothing, upkeep on your home, pet food, your health insurance, vacations, etc. The list encompasses just about anything you spend your money on - because all those things ultimately benefit the child. About the only thing that you should not use child support money on would be to engage in illegal activities, such as using it for cocaine or marijuana purchases, illegal pornography, illegal betting, and the like. Those kinds of things do not run for the benefit of the child.

Child support may be used for any purpose for the benefit of the child,i.e., food, lodging, clothing, medical, entertainment, travel, etc.
