How do I get child support, when I'm still married?

I'm currently married and not going through a divorce because of financial reasons. I've tried to get support (with help from the state), but the case was thrown out b/c we were still married. The district judge said that we had to go through a circuit court for a divorce first. I can not afford an attorney and do not know how to do it myself; I've tried to get legal aid to help and was turned down, because he wasn't a threat anymore. He and I haven't been together for a year and he is currently living with another female. My daughter will be a year old this month and I haven't ever received any assitance from him whatsoever. What can I do if anything? I need financial help from him badly.

Go to your local DHR office and tell them you want to get child support started. I have heard of some judges not granting child support when the parties are still married, but I have never heard of DHR turning down a case on that basis.
