Legal Question in Family Law in Alabama

child support

i have a son in college and i am to pay 1/2 of his schooling plus some spending money. he's in his last year and i asked him to file for student aid and my ex and i would pay it off on time. he refuses. i can't pay my half all at once. i'm tapped out. also, my daughter turns 19 in march and i filed paperwork to stop child support which i am also paying my son even though he's almost 22 years old. they have both moved out of their legal guardian's home. now the guardian(grandmother) is suing me to modify support. i don't want to stop helping my kids. i just want the child support to stop coming out of my check. if they no longer live with the grandmother, does she have a leg to stand on. ALABAMA

If your children have both graduated from high school and are over the age of 18, you have no obligation to support them under the law. I'm relieved that you still want to help. I don't see how the grandmother will get very far.

If she has already filed, then you could do an answer and a counter-petition. If she has not, you should file a motion to stop the child support. Hiring an attorney would make things easier since you live in Alabama, but you may be able to do it yourself by looking at the family law forms on the Florida courts webpage.
