Legal Question in Family Law in Alabama

Child Visitation

My daughter will be 16 this summer and does not want to go to her dad's (6 hours away) this summer for child visitation due to planned activities (job, church camp, performing in a theatre musical, voice lessons, etc.). If her dad is determined that she come, can she decide she is not going?

Re: Child Visitation

Was she going to drive herself over there? If so, and she's not at his place and not at your place, then you have the issue of a runaway child.

Was your ex- coming to your house to pick her up? All you have to do is make her available. You don't have to pick her up and place her in his car.

Were you driving your child to your ex-'s house, or meeting halfway? Then you must do that. Again, if she won't get out of the car you don't have to push her out and drive away. I would call the cops and get a police report that she won't get out of the car. Then at least you have it documented that you tried.
