children and taxes

which parent has legal rights to claim a child for tax purposes? our divorce decree did not mention anything about this. my ex-wife has joint custody with visitation but our daughter lives with me full time. my ex does not pay support but she does cover half of dr. co-pays and some school tuition. any help you can give will be greatly appreciated. thanks joel

Presumption is for the custodial parent. Of course, you can always agree otherwise, but, in lieu of agreement the presumption would be that you have the deduction.
