Legal Question in Family Law in Alabama

children testifying

I have 2 teenagers ages 14 and 16 who have been at their fathers for visitation. Their father has a 5 yr old stepdaughter who's father is sueing for custody. My question is, if supeonaed, do my children have to testify in court? or do I have the right as their parent, with full custody rights, to deny them testifying? There have been alot of very unpleasant things going on at their father's house, that I just became aware of, and they are not having anymore contact with their father. I would prefer them not having to relive anything and would rather put all this behind us. Do they have to testify?

Thank you for your answer!

Re: children testifying

At that age they probably would have to testify if subpoenaed to court, but the judge would have the final say. Consult an attorney in your area to see what you might could do to try to convince the judge not to make them testify.
