Legal Question in Family Law in Alabama

childsupport

Hi, I have been maried for 9yrs,two weeks ago child support network call my husband on his job and shared that they were collecting support from a child that was possibly his? My husband wanted to know why 12yrs. later, the child is 12yrs.old now? No one ever tried to contact him before, there is history behind all of this two other guys were paying childsupport, but later requested blood tests to prove paternity, the results came back negative. the mother had to pay the money back, now possible daddy no.3 is up for paternity test. they said he would receive a certified letter in a couple of days, so he could go to alabama to take a paternity test. ( we live in georgia). child support network also told him that he would have to pay retro payments, if the child is his. can they do that? they never contacted him before, the mother never contacted him before now. The biggest question is this, will my income be counted as his income when determing child support payments, i didn't farther the child, he did? we also have two children together, ages 9 and 7. also if he makes 1200.00 every two weeks what percent will be paid in child support? please help! the paternity of this child depends on whether we will stay married or divorce?

Re: childsupport

your income will not be included in determining child support. only the income of the father and income of the mother of the child are counted to determine child support. the amount of child support is determined by a chart in the alabama rules of court after adding the total gross income of the mother and father. then each party pays the percentage of the child support figure equal to the percentage his or her income is to the total gross income. there are a few other calculations concerning insurance and child care and other child support payments. please call me if i can be of further assistance.
