Legal Question in Family Law in Alabama

Consideration of learning disability in calculating child support

I am in the process of having the child support updated, my child has a sever learning disability that requires, above average costs, in tutoring and medical. He will be going off to college soon, where he will continue to need tutoring in several classes. In all probability it will take him longer to get through college. Common for most people with learning disabilities. My question is can or will the courts consider his learning disabiltiy as some type of extenuating circumstance and increase the amount of child support in some form to compensate? Can I still receive some type of support while he is in college to help cover costs associated with his disability?

Re: Consideration of learning disability in calculating child support

child support in alabama generall ceases at age 19, however college expenses can be ordered by a court to be paid in some part by the non-custodial parent if a proper and timely petition is filed with the court. also special circumstances such as you describe may provide a court grounds to extend and perhaps increase child support. call me for further information at 205-879-9595
