Legal Question in Family Law in Alabama

Custodial parent moving out of state

My former husband and I have joint legal custody and I am primary physical custodial parent. I have an opportunity to move to Georgia for better job plus schools are better. Former husband has filed objection to this move on grounds it interferes with his visitation. I have agreed to meet him half-way in distance and nothing in his visitation schedule would change except for one week day per week. Is it not against my constitutional rights for him and/or the state court to determine whether or not I can move and take my daughter?

Re: Custodial parent moving out of state

The court's primary concern is the best interests of the child. In this regard, maintaining regular and meaningful contact with the parents is of the utmost importance. The court will weigh all of the factors and considerations and, in the end, what is best for the child will be the ruling. What you want comes second.
