Legal Question in Family Law in Alabama
custody and not abiding by the divorce decree
My husband and his ex-wife have joined custody over their 11 year old son. He is supposed to live with his father during the schoolyear and with his mother during summer and Christmas break. My husband and I got married 1/2 a year ago and last weekend ( we were supposed to pick him up because school starts tomorrow), she decided that she will not let him go back. My husband drove all the way to Georgia (we live in Alabama about 7 hours away from were she lives) and she refused to hand him over. Furthermore did the judge decide, that she had to move out of their former home by last December ( sell it and give my husband 1/2 of the money, or take a loan in her name and change the status of ownership, so my husband can take another VA loan once we want to buy a home). By the way, she left my husband because she had a child with another man and when my husband came back from Afganistan( he is in the army) the other man and his child were living in his house and refused to move out.He was awarded the right to take his son to his new duty station-Germany( my husband payed for the tickets for him during the winter and the summer/ she was supposed to pay part). She has not called her son or send anything in the last two years. Need help..

Re: custody and not abiding by the divorce decree
He needs to go back to court, and I am guessing venue is in Georgia where the divorce and custody was decided, and there file a contempt. You would need a Georgia lawyer in that case.
