Legal Question in Family Law in Alabama

Custody/ adoption in AL

I have had this child in my home since before birth, I supported the bio-mother while pregnant. I was to adopt at birth. The bio-mother backed out of the adoption. But the child continued living with me. We eventually had to file for custody to protect this child from her druggy mother. We were awarded full custody. We wish to adopt. Question is, is there a lengh of time that we have to wait to file? I heard one yr. If so, is that from the court awarding custody, or the entire time child has been in my care. Mother abandoned the child in dec. Went back to tenn. Child is in ALA. Born in ALA. There are 3 other babies. The Grandparents have adopted two and have custody and working on adopting the third. We are very close and are raising all kids together. They support this custody/ adoption 100% with us. How does Ala Law read on this?? Thanks soooooooooooo much !

Re: Custody/ adoption in AL

One year is the rule; however, the probate judge can waive this at their discretion.
