I recently was divorced from my husband. He agreed to pay the mortgage on our home until January of 08 when I would start paying, if I wanted to keep the home. He didn't and incurred about $10,000 of extra charges on the mortgage. In the divorce, it stated that I'd take the home if I could obtain financing in my name, but I cannot nor do I want to now that the price is higher due to his actions. I've made the payments on time during my obligated time frame, but am now wanting to moving out and want to get rid of the home since he's messed the price up. The home is in his name alone, but was purchased after our marriage. Also, I had someone lined up to buy it, but he's refused to meet or contact me. What should I do?

If there was an agreement which was incorporated into your decree stating he would make the payments, then he is in contempt and you need to get a lawyer to file for relieve and in that manner may get his cooperation as well at this time.
