Legal Question in Family Law in Alabama
Family law, child custody
How can I stop my ex-girlfriend from leaving the state with my daughter? When our daughter was born we agreed to split custody with no child support, because I would keep her 1 week and she would keep her the next and so on. This has worked out great until last August. She kept my daughter from me for 4 months and when I finally found her she wouldn't let me see her until I signed a paper (that wasn't notorized) saying that she could take our daughter during the school year and I keep her during the summer months and extended holidays. She had another child, married the father of the other child and has just had another child by this person. Once I got my daughterI saw that she was infested with lice and infintago (not sure of the spelling). I took her to the doctor immediately so this could be on record. I don't feel she is capable of taking proper care of our daughter. We live in Alabama and her husband is in the army and has been stationed in Washington state and she is taking her. She won't honor the forced agreement now. What can I do?

Re: Family law, child custody
As of now, you have no legal rights and you need to address that issue immediately before you lose the right to do anything. You probably failed to register with the Putative Father's Registry at DHR. That could be fatal to your claim of paternity if you do not file a petition for paternity in family court and then allege dependency as well in that the mother is an improper parent and you want custody. Of course, this is not easy and you will absolutely have to get an attorney or you will make mistakes along the way.
