Legal Question in Family Law in Alabama
My fiance left her ex boyfriend with her 2 childen and moved to her moms because of abuse etc. there has been no child custody hearing (set for 3 months later). She has a meeting with her attorney next week. However, his attorney sent a letter stating that she can not do this or that etc. ALso , states no overnight guest of opposite sex (does not list what hours or when or what). What exactly does this imply for myself visiting? and does she have to go by this since no judge has ruled on anything or is it jut bette to play by the rules on this? I do not ever stay over night to start with but on weekends that her kids are with him until everything is final she comes to my house and stays. Is this ok since no kids are involved? Also we are getting married next month(he does not know) and how will this affect the overnight guest statement? Thanks

Her ex boyfriend has no rights as he is not the legal father unless it has been in court previously. I do not know what county you are in because it depends on how conservative the judge is there as to whether the over night visitations by a member of the opposite sex affects custody. If he is not paying any child support, whether court ordered or not, he should pay. The overnight should not affect since they were not married either!!
