Legal Question in Family Law in Alabama

Please Help-At Wits End

I have 2 children (7 and 1) by the same man. He's already on child support for 7yo, but owes $9,000 in arrears. He's denying 1yo and didn't sign BC. Since I am requesting back support, he told me that he is going to get custody of the kids. How likely is that? He says that I am unfit because 1)I abandoned our son (I let our son spend last summer with him). 2)1yo is always sick (she goes to daycare) 3)I dated someone else while we separated and ended up with something (nothing serious). 4)I was seeking advice from an attorney from my church and he claims the attorney was having a relationship with me (He didn't represent me. I never paid him. He was nice enough to give free legal advice). Are those grounds to take my kids? Doesn't he still have to pay for the months he had our son? He became commonlaw married to this woman with kids of her own so that he could get his payments reduced. Will a judge consider that? Also, do I have to go through the same procedures as before to get CP for 1yo, or can I mention it when we go to court next month?

You have named quite a few potential problem areas. I do not think that I could adequately answer your questions in this forum. He most likely cannot get custody, but you need to consult with an attorney face to face as soon as possible.
