Legal Question in Family Law in Alabama
My ex husband was recently laid off from his job. He is now drawing unemployment and also working for someone for cash. Our divorce papers say that he is supposed to pay me $300 a month child support for our daughter and half of any medical and child care expenses. He told me that he would pay me out of the cash that he was making, but currently he is over a month late and hasn't attempted to pay anything for our daughter's daycare. What course of action should I take?

Where he gets the money from does not really matter. What is important is that he pay his monthly child support obligation. The loss of his job, by itself, does not terminate his responsibility for paying child support.
If he does not resume paying his child support, your attorney can file a petition with the court to have him held in contempt. Your ex would then have to go in front of the judge and explain his actions. He would also have to pay his past due support or face the risk of going to jail for nonpayment of support.
