Legal Question in Family Law in Alabama
Everyone involved lives in Florida, but Alabama requires he still pay them $18K
My husband has been divorced from his first wife since 1985, and in the divorce papers in clearly states that no specific child support shall be paid. Almost ten years later he was in jail for 18 months, during which time his ex-wife received monthly checks from the state to support his daughter and a step-daughter. Upon his release he had to go to court regarding the money that he would owe for that time. The judge in this case told him that he would pay child support from here on out, even for the child that isn't biologically his. They have refused paternity tests, taken our income taxes each year, and now are requesting him to appear in court right after the new year. My husband believes that there is a law where two judges from the same type of court cannot overrule the other. (i.e. two circuit court judges)We are distraught over the upcoming court date as we have no one to represent us, and in the past resolving this issue has been impossible. Any help on this matter will be appreciated. Thanks.
