Legal Question in Family Law in Alabama
Jurisdiction- Child custody/support
During the time my family lived in VA, I was told that all custody/support matters had to be heard in AL, as that was the original court for the divorce/custody and my ex (non-custodial parent) still lived here. Was that correct? Back in Dec., 2003, my ex filed for change of custody. We had been in VA since Jan.,2001. Several VA attorneys told me that they would not have jurisdiction, so I retained an atty in Montgomery. My understanding was that the original court would always have jurisdiction as long as one of the original parties resided in the state. Has this changed since then? Thanks for any info you can provide...

Re: Jurisdiction- Child custody/support
no it has not changed, the original court maintains jurisdiction unless both parties agree as to a change or neither party lives in the original jurisdiction
