can i take my kids

my husband and his family are abusive i'm leaving the state to stay with my sister until the divorce is over can i take my kids. he threaten to take my kids from me if i try to leave

As this is your current residence, to file for divorce now you would have to file here, I would suggest you not move. Rather, what you need to do is file for temporary custody and child support pending a final divorce and if there is documented abuse, physical and/or mental, allege that to obtain a protection from abuse order. Your lawyer will know how to do these things.
