law on lease agreement with my husband

I have a husband whom I have been married to for 4 1/2 years., throughout the years he has verbally and physically abused me, and done the verbal abuse in front of my 11 year old daughter (which is not his)...she is terrified of him. We have a 14 month old son together, who both kids do not deserve to be in this environment of fighting. I am trying to alliviate the situation, by living seperate houses. He is on the lease with me and he refuses to leave, even though the children are in there own home where they are comfortable. He says he has every right to stay here until the lease is up. Is there nothing I can do?
