legal last name for unborn child-parents unwed

my daughter is unmarried and pregnant by her boyfriend of 2 years. boyfriend wants child to have his last name. I think last name should be same my daughter's. i need your advice please. important note-boyfriend is still married-has signed the divorce papers-but wife hasn't signed them. what would you advise if it were your child? please do not show my email address or zip. thanks

Under Alabama law, your daughter can pick any last name she wants the baby to have, be it her name, her boyfriend's name, or some other name. Personally, I would opt for your daughter giving the baby her last name. There are pros and cons either side. It would certainly not affect her right to child support, which I hope she is pursuing.
