Legal Question in Family Law in Alabama

How long do I legally have to hold ex-husbands items in my shed before I can just keep them? We separated Feb.2009 and divorced Nov. 2009. We deceided to split camping items but he never came back in April 09 to get items like said he would.

Alabama's unclaimed property law deals mostly with things like unclaimed deposits in banks where the holder of the property can't find the owner. There are also statutes which deal with found property where the finder holds the property for the true owner. In this case, the pratical answer would be to notify your ex-husband by certified mail that you have his property and that he must claim and remove it within a reasonable time (30 days), and that 30 days after he fails to claim the property you will dispose of it. If there is real value here -- something big -- it would make sense to go back to the court and ask them to allow you to declare the property abandoned by him. Just remember, finders keepers is the law of the playground, not the law of the State of Alabama. Notify him, and do it all in writing. You may want to get a lawyer to do the demand for you.
