Loosing Custody of minor children

Can custody of minor children be lost to a father under the following circumstances? Mom and boyfriend get into a fuss/fight. Boyfriend head-butts the mom in the heat of the argument. She signs a warrant on him for domestic violence 3rd and he pleads guilty. The two get back together (not living together). The fight did not occur in front of the children. He has never hurt the children before and had never hurt the mom before.

It depends on where in Alabama you are and whether a report is taken by DHR, if not, there should be no problems. Usually, with domestic violence classes, then it is okay.
